Nothing Innocent About It: The Impugnaciones are Back

The newly re-packed, 100% chavista Supreme Tribunal’s Electoral Chamber has just come back from vacation to receive six separate impugnaciones (legal challenges) against involving eight seats won by MUD on December 6th.

1.- Expediente N° AA70-E-2015-000140: El ciudadano PEDRO LUIS CABELLO HERMOSO, titular de la cédula de identidad N° 10.924.929, asistido por la Abogada Hilaria Michael Márquez Betancourt, inscrita en el Inpreabogado bajo el N° 37.279, interpuso recurso contencioso electoral conjuntamente con medida cautelar de suspensión de efectos contra las ELECCIONES DE DIPUTADOS Y DIPUTADAS A LA ASAMBLEA NACIONAL, EN LA CIRCUNSCRIPCIÓN ELECTORAL NÚMERO 01, DEL ESTADO AMAZONAS.

2.- Expediente N° AA70-E-2015-000141: El ciudadano NESTOR FRANCISCO LEON HEREDIA, asistido por el Abogado Rafael Puertas, interpone recurso contencioso electoral conjuntamente con medida cautelar de suspensión de efectos contra las “ELECCIONES DE DIPUTADOS Y DIPUTADAS A LA ASAMBLEA NACIONAL, EN LA CIRCUNSCRIPCIÓN ELECTORAL NÚMERO 02, DEL ESTADO YARACUY…”.

Se dio cuenta a la Sala.

 3.- Expediente N° AA70-E-2015-000142: El ciudadano ESTEBAN ARGELIO PÉREZ RAMOS, actuando en su condición de candidato a diputado a la Asamblea Nacional por la representación indígena Región Sur, en las elecciones celebradas el pasado 6 de diciembre de 2015, asistido por la abogada HILARIA MICHAEL MÁRQUEZ BETANCOURT, interpuso recurso contencioso electoral conjuntamente con medida cautelar, contra las “ELECCIONES DE DIPUTADOS Y DIPUTADAS, POR LA REPRESENTACIÓN INDÍGENA A LA ASAMBLEA NACIONAL REGIÓN SUR…”.

4.- Expediente N° AA70-E-2015-000143: Los ciudadanos SUMIRÉ SAKURA DEL CARMEN FERRARA MOLINA y PEDRO LUIS BLANCO GUTIÉRREZ, actuando en su condición de candidatos a diputados a la Asamblea Nacional, en las pasadas elecciones del 06 de diciembre, asistidos por el abogado Pablo Enrique Paradas Álvarez, interponen recurso contencioso electoral conjuntamente con medida cautelar contra “LAS ELECCIONES DE DIPUTADOS Y DIPUTADAS A LA ASAMBLEA NACIONAL, EN LA CIRCUNSCRIPCIÓN JUDICIAL NÚMERO DOS (2), DEL ESTADO ARAGUA…”.

5.- Expediente N° AA70-E-2015-000144: La ciudadana ROSA DEL VALLE LEÓN BRAVO, actuando en su condición de candidata a diputada a la Asamblea Nacional en las pasadas elecciones celebradas el 6 de diciembre de 2015, asistida por el abogado Enrique Paradas Álvarez, contra “LAS ELECCIONES DE DIPUTADOS Y DIPUTADAS A LA ASAMBLEA NACIONAL, EN LA CIRCUNSCRIPCIÓN ELECTORAL NÚMERO TRES (3), DEL ESTADO ARAGUA…”.

 6.- Expediente N° AA70-E-2015-000145: Los ciudadanos ELVIS EDUARDO HIDROBO AMOROSO y HIPOLITO ANTONIO ABREU PÁEZ, titulares de la cédula de identidad Nos. 7.659.695 y 6.289.959, asistido por el Abogado Pablo Enríquez Parada Álvarez, inscrito en el Inpreabogado bajo el N° 134.720, interpone recurso contencioso electoral conjuntamente con medida cautelar de suspensión de efectos contra las ELECCIONES DE DIPUTADOS Y DIPUTADAS A LA ASAMBLEA NACIONAL, EN LA CIRCUNSCRIPCIÓN ELECTORAL NÚMERO CUATRO (04), DEL ESTADO ARAGUA.

  1. We knew that they were going to use every trick in the book (and some new ones) to try to stop us from having the majority in the AN. They are desperate thugs but now the ball is on our court and we need to respond forcefully, that is every legal response possible and CALLE, CALLE y MAS CALLE

  2. Czar Nicolas granted the people an elected Duma, but when they voted his policies down, he tried to rule without it.

    This did not end well for the Czar.

  3. I cannot see chavismo allowing a 2/3 MUD majority to ever sit for an AN session. I could be wrong, but if they do, it would go against everything they’ve shown to be so far. MUD could call a recall referendum or constitutional assembly, both of which would mean, sooner or later, chavismo’s downfall. I do think they care about perceptions and the democracy facade, but not enough to allow MUD to have the finger on the trigger even for a few hours. The political or international cost of shaving at least one deputy from MUD is one they are very willing to pay. It could backfire on them, and most likely, it will. But they’ll try it anyway.

  4. The thing is that Venezuela’s economy is in free fall and Chavismo has no political capital to take any measures. The mood in Venezuela is going to be like dry tinder as daily life becomes more and more difficult.

    The international community will probably heap scorn on Chavismo and there is a remote chance that they will take economic measures against Venezuela. Removing Venezuela’s oil from the market may be something that many producers would favor to address the glut, so there may be more motivation than the democratic process in Venezuela.

    I don’t think they will succeed to hold on for long, porque si no los agarra el chingo, los agarra el sin nariz.

  5. Comunicado del MUD: “El proximo 5 de enero se instalará la Asamblea Nacional, el único parlamento reconocido por la Constitución de la República Bolivariana de Venezuela, y lo hará con la mayoría calificada democrática que el pueblo construyó voto a voto, para bien de todos los venezolanos.”

    MUD Statement (Excerpt, Translation): “The following 5th of January the National Assembly will be installed, the only parliament recognized by the Constitution of the Bolivarian Republic of Venezuela, and it will be with the democratic qualified majority that the public built vote by vote, for the benefit of all Venezuelans.”

    Gauntlets are being thrown down and lines are being drawn. Indeed, “So it begins.”

  6. Maybe not.. it still remains to be seen if the self appointed leader, and two time loser, Capriles will want to have some more dialogue, as the streets are no place to resolve anything.

  7. But wait a minute – the gov and TSJ says the challenge to the 22 seats was an error by the opposition. Was it only the quantity they were on about?

  8. Rent a hall. Sit the elected deputies down in the hall. Invite the Chavistas. Pass a law, say one freeing political prisoners. Include a specific direction to named persons or positions, requiring the holder to fulfill it. Specify the jail term that individual will (eventually) serve for failure to do so.

    Let’s see what PSUV loyalty amounts to as their legitimacy slips away.

  9. If they were really clever, they would also gin up challenges to a few PSUV deputies by fringe-left parties. The CNE would then uphold challenges to five MUD deputies and one PSUV deputy, leaving the AN at MUD 107 PSUV 54, i.e. one less than a 2/3 MUD majority.

    This would make the maneuver plausible – “one of our guys got bumped too!”

    Karl above was right to say that the MUD must be prepared to take to the streets.
